Crosson v. Sunrise Senior Living et al.

In Crosson v. Sunrise Senior Living et al.Judge Whitehead of the Essex County Superior Court entered summary judgment on claims for breach of contract and negligence made against the facility’s former Executive Director.  The plaintiff alleged negligence as well as claims for breach of contract against the facility’s Executive Director arising from her mother’s fall and subsequent discovery, on grounds that it was the ED’s duty to carry out the provisions of the contract between the resident and the facility. After considering the pleadings and completed discovery, the court found that there was no genuine issue of material fact and that the defendant was entitled to summary judgment as a matter of law. Consequently, the court indicated that the Executive Director could not be sued individually as a result of her title or position, despite the existence of state regulations outlining its inherent duties.
