$54M New Mexico-Nursing Home Verdict - Reversed

The State of New Mexico Appellate Court reversed and remanded for a new trial a $54M dollar verdict against a large nursing home operator who allegedly failed to properly monitor and assess a resident who died of a gastrointestinal bleed.

The court stated in its opinion "reversing the jury’s award of damages because it was impossible to determine whether the jury based its verdict on erroneous contract instructions or some other theory of damages."  Plaintiffs can now appeal this ruling to the New Mexico Supreme Court.
