$2.7M Dollar Arbitration Award in TN Nursing Home Case

A nursing home company doing business in TN received a $2.7M arbitration award last week.  The case stemmed from the development of wounds on the resident’s heel and coccyx.  The arbitration was heard by a panel of three and Judge Lee Duggan (ret.) of Houston, TX completed the verdict form.  Of particular note were awards for punitive damages ($1.5M) and attorney’s fees under the TN Adult Protection Act (TAPA) ($400K).  Plaintiff’s counsel was Marks Balette & Giesel, Houston, TX.
