Judge finds that the ADR agreement valid despite arguments from plaintiff’s counsel that the court does not have subject matter jurisdiction, the person who executed the agreement lacked authority to bind the residnet to the agreement and that the agreement was substantively unsconscionable. 

Of particular note is that plaintiff’s argued that the court lacked jurisdiction because the agreement did not provide that the arbitration take place in the state boundaries of KY.  The court disagreed and relied the KY Arbitration Act to rule the court did have jurisdiction.
