Settlement in Massachusetts Fall w/Fracture Case $120K

Case involved an elderly resident who was non-ambualtory and non communicative who suffered a fractured hip which required surgery.  She had been transferred using a hoyer-lift, facility reported no fall of other incident and could not explain how the fracture occurred.  Plaintiff argued the theory of "res ipsa loquitor".  Defendants filed a MSJ – the case settled pre-trial for $120K.
