Law firm: Nursing home prevails in Jefferson County neglect trial

BIRMINGHAM, Alabama — Huie, Fernambucq & Stewart LLP said attorneys H. Lanier Brown II and Anna Katherine Bowman won a verdict for a nursing home after a eight-day trial in the Bessemer division of Jefferson County Circuit Court. Jon Terry of Bains & Terry assisted in the defense.

A
suit sought compensatory and punitive damages against the facility,
claiming that a resident fell and sustained a right hip fracture as a
result of negligence, the firm said. The resident had a pressure sore on
his right heel, and the plaintiff alleged the facility did not provide
proper care, ultimately causing the amputation of the right leg below
the knee.

At trial, the defense team established that the
nursing home had properly assessed the resident and implemented
appropriate interventions to reduce the chances of a fall, the firm
said. It added that evidence established that the pressure sore
developed before the resident was admitted to the nursing home.
