Curry v. East Village Nursing Home Inc.
In Curry v. East Village Nursing Home, Inc., the plaintiff filed suit against East Village in Middlesex Superior Court seeking both compensatory and punitive damages. The plaintiff’s mother was sixty-seven years old when she died from respiratory failure, bilateral pneumonia, and sepsis. The plaintiff alleged that the facility was negligent in failing to communicate effectively the nature and severity of her condition to appropriate medical personnel, thereby causing a delay in treatment. Following oral argument on East Village’s motion for summary judgment, the Court entered summary judgment in favor of East Village on four counts, including all claims that the facility’s conduct was wanton, willful, reckless, or constituted gross negligence.
