Alabama Physician Sued in Mississippi Dismissed for Lack of Personal Jurisdiction
After deciding she wanted cosmetic surgery to improve her appearance, the plaintiff who was a Mississippi resident began searching for plastic surgeons in the Southeast. After much study and research, she chose to travel to Fairhope, Alabama for a series of plastic surgical procedures.
Following the last such procedure, plaintiff claims to have suffered a number of very serious burns to her legs which caused scarring and disfigurement. Plaintiff sued both her physician and his clinic in federal court in Mississippi, arguing that jurisdiction was proper as the defendants maintained a web site which Mississippi residents could view and utilized the telephone to schedule appointment with their Mississippi patients. The court disagreed and dismissed the physician as well as his clinic from this matter.
