In reliance on Ally Cat, the Trial Court ruled that it did not have jurisdiction to consider the facility’s motion to enforce because the Arbitration Agreement did not provide that arbitration would take place in Kentucky. 

·         The COA pointed out that this factual scenario does not necessarily preclude the Trial Court’s jurisdiction, which can be afforded under the Federal Arbitration Act in proper circumstances. 

·         So it remanded to the Trial Court for analysis of the issues related to jurisdiction pursuant to the Federal Act.
