Today’s Health Lawyers Weekly will report on a Tennessee appellate case decided on Tuesday in which the appeals court set aside a trial court decision denying a nursing home’s motion to compel arbitration.  The appellate court found that the arbitration agreement was not a contract of adhesion and reversed and remanded the case back to the lower court.  See Estate of Mooring v. Kindred Nursing Ctrs., No. W2007-02875-COA-R3-CV (Tenn. Ct. App. Jan. 20, 2009) or, if a member, check the Health Lawyers Weekly section of our site later today when the case summary will be posted:
