This is a US District Court case out of the Western District if Kentucky where the court granted a motion to stay the litigation and proceed to arbitration. The agreement was signed by a valid POA. The plaintiffs argued that the facility failed to explain the documents to the POA and led her to believe that the document needed to be signed in order to secure reimbursement. The POA however admitted that she did not read the document and relied uppon the statements made by the facility. There is a nice discussion about fraud in the inducement as a well as the POA’s obligation to read documents if given the chance.
